How it works

  1. 1

    Ownership established

Who created it and who owns it are separate questions. We sort this out before filing, because a registration in the wrong name is worse than none.

  2. 2

    Application prepared

Form completed and the work prepared for deposit in the required format.

  3. 3

    Filed with the Copyright Office

Submitted to IPO Pakistan, with any query answered on your behalf.

  4. 4

    Certificate issued

    Registration certificate delivered on grant.

Unlike a trademark, copyright arises the moment an original work is created in a fixed form. You do not need to register to own it. What registration gives you is a formal, dated, official record of the work and its ownership, which is exactly what you need when the question becomes contested.

The value shows up in disputes, in licensing negotiations, and in due diligence. Asserting "I wrote this in 2022" is weaker than producing a certificate. If you have ever tried to prove authorship from a folder of undated files, you understand the difference.

What can be registered

  • Literary works, books, articles, manuals, and computer software source code
  • Artistic works, drawings, paintings, photographs, graphic design, architectural drawings
  • Musical works and sound recordings
  • Cinematographic works, film and video

Note what is not covered: ideas, methods, and facts. Copyright protects the particular expression, not the underlying concept. A business method is not copyrightable, though the manual describing it may be. Names and short phrases are generally not copyright subject matter either, that is trademark territory.

Software: the case where this matters commercially

For a Lahore software house, copyright is the intellectual property that actually matters day to day, because source code is a literary work and the code is the asset. Two situations make registration worth the effort:

Product companies. If you have built a product rather than doing project work, the code is what a buyer or an investor is valuing. A clear, documented ownership chain, with registration as part of it, is a diligence asset.

Disputes with former team members. The recurring scenario is a developer who leaves and takes the codebase to a competitor or a client. Sorting out who owns what, after the fact, with no written assignment and no registration, is slow and expensive.

The ownership trap: contractors and employees

This is the point worth taking away from this page even if you never register anything.

Work created by an employee in the course of employment generally vests in the employer. Work created by an independent contractor does not automatically transfer to the person paying for it. Without a written assignment, the freelancer who built your app may own the copyright in it, regardless of the fact that you paid the invoice in full.

Almost every Pakistani software house uses contractors. Very few have proper written IP assignments from all of them. It is invisible until an acquirer asks, and then it is the item that holds up a transaction. Fix it with a short assignment clause in every contractor agreement, see agreement drafting, and get it signed now rather than chasing former contractors later.

Is it worth registering?

Honestly, not always. For a one-off article or a piece of marketing collateral, the cost of registration outweighs the benefit. For a software product, a body of published creative work, a design that is central to your business, or anything you expect to license or defend, it is worth it. We will tell you which side you fall on rather than registering everything you send us.

Licensing: making the work earn without selling it

Ownership and permission are separable, and most copyright commerce lives in the gap. A licence lets someone use the work on defined terms, exclusive or non-exclusive, for a territory, for a period, for a purpose, while ownership stays with you; an assignment transfers the ownership itself, and to be safe it should be in writing and signed. The disputes we see almost never concern the law; they concern terms nobody wrote down: a designer's logo used on products the client never mentioned, software "bought" outright when only a licence was priced, a photographer's images resold onward. A page of clear terms at the start, stating what is licensed and what is reserved, prevents nearly all of it, see agreement drafting.

Infringement online: the practical playbook

For most Pakistani creators and software houses, enforcement is less about courtrooms than about takedowns. Marketplaces, app stores, hosting providers and social platforms all operate copyright complaint procedures, and a complaint backed by a registration certificate and a dated ownership trail is processed very differently from a bare assertion. The playbook that works: preserve evidence first (dated screenshots, archived pages), send the platform complaint with your proof of ownership, follow with a direct legal notice to the infringer where they are identifiable, and reserve litigation for the cases with real money attached. Registration earns its fee here, it converts "I say it is mine" into a document a platform's abuse team accepts.

Frequently asked questions

Do I need to register copyright to own it?

No. Copyright arises automatically when an original work is created in fixed form. Registration provides a formal, dated official record of the work and its ownership, which is what carries weight in a dispute, a licence negotiation or due diligence.

Can software be copyright registered in Pakistan?

Yes. Source code is treated as a literary work and can be registered with the Copyright Office at IPO Pakistan.

Who owns work created by a freelancer I paid?

Without a written assignment, potentially the freelancer, paying an invoice does not by itself transfer copyright. Employee work created in the course of employment generally vests in the employer, but contractor work does not. This is the most common IP gap in Pakistani software companies.

Does copyright protect my idea?

No. It protects a particular expression, not the underlying idea, method or facts. A business method is not copyrightable, though a manual describing it may be.

Can I copyright my brand name?

Names and short phrases are generally not copyright subject matter. Brand names are protected by trademark registration instead.

How long does copyright last?

For a substantial term measured from the author's life or from publication, depending on the type of work, long enough that it is rarely the operative question in a commercial dispute. Ownership and evidence usually are.
