Bahria Town Lahore is a property market more than a neighbourhood, and a very large share of its owners live abroad and bought as an investment rather than a home. That produces a distinctive set of tax issues: advance tax on transfers, plot files bought and sold before possession, remittance documentation for money sent in to fund a purchase, and wealth statements that have to explain assets acquired by someone with no Pakistani income.
What Bahria Town usually needs
- Filer status secured before a plot or file transfer, 236C and 236K rates differ sharply
- Non-resident return filing for owners in the Gulf, UK and North America
- Remittance evidence assembled to explain the source of purchase funds
- Plot file transactions reflected correctly in the wealth statement
- Capital gains on plot sales computed with the advance tax adjusted
The transfer counter is the wrong place to discover your ATL status
Advance tax on the purchase and sale of property is charged at rates that differ substantially between an on-time filer, a late filer and a non-filer. On a Bahria Town transaction that difference is a serious sum, and beyond the rates, recent law restricts certain property transactions altogether for a person who is not an eligible filer with sufficient declared resources.
Getting onto the list takes days if you have a clean history and longer if you have several unfiled years. Either way, it is not something to start on the morning of a transfer. See getting back on the ATL.
Plot files and the wealth statement
A great deal of Bahria trading happens in files before possession. From a tax perspective the important discipline is unglamorous: record what you paid and when, keep the file transfer documents, and reflect the holding in your wealth statement at cost.
The problem case is an owner who has bought and sold several files over a few years, never filed a return, and then acquires a possessed plot. The asset appears; the income to explain it does not. That is exactly the pattern that produces an enquiry into unexplained wealth, and it is much easier to prevent by filing along the way than to explain afterwards.
Overseas investors: document the money going in
If you are sending money from Dubai, Jeddah, London or Toronto to fund a purchase, send it through the banking channel and keep the remittance advices. Remittances through proper banking channels are not treated as your taxable income in Pakistan, but the evidence has to exist. Money that arrives outside the banking system is considerably harder to explain when FBR asks how the plot was funded, and it will be asked at some point if you are acquiring visible assets with no filed income.
You do not need to come to Pakistan for any of this. See non-resident filing.
Selling: the advance tax is adjustable
Advance tax collected under section 236C when you sell is not a final cost, it is adjustable against your tax liability on the gain. Sellers who never file simply absorb it. Keep the challan, file the return, and the position is computed properly rather than assumed against you.
