First: do not ignore it
Every FBR notice carries a deadline. Missing that deadline does not make the matter go away, it removes your opportunity to explain, and lets the department proceed on its own view of the facts. The Commissioner can make a best-judgement assessment under section 121 based on FBR's estimate of your income. That assessment becomes a demand, and demands are recoverable, including by attaching your bank account.
Almost everything is manageable inside the deadline. Very little is manageable after it. If you have a notice in front of you, that is the whole message of this page.
What the common notices mean
Section 114(4), notice to file a return
FBR believes you were required to file a return for a specified tax year and did not. This is the most common notice by a wide margin, and it is usually triggered by information FBR holds about you, a property transaction, a vehicle registration, bank data, withholding deducted against your CNIC. The remedy is normally to file the return within the period the notice gives. Ignore it and section 121 follows.
Section 122, amendment of assessment
FBR is proposing to amend an assessment already made, because it considers income was understated, a deduction was wrongly claimed, or the wealth statement does not reconcile. This is more serious than 114(4) because there is a substantive dispute about the numbers. The reply needs evidence, not assertion. Sub-sections you may see referenced include 122(1), 122(5), 122(5A) and 122(9), each with its own basis and its own procedural requirements, the specifics matter and are worth having read properly.
Section 176, notice to furnish information or documents
A demand for specific records or information. It looks administrative and people treat it casually. It is often the opening move of an enquiry, and what you provide here shapes everything that follows. Answer it fully and accurately, but answer what was asked, not more.
Section 177, audit selection
Your case has been selected for audit. This is a process, not a single reply, and it is covered under audit representation.
Section 182, penalty
A penalty is being imposed, usually for late filing, non-filing, or failure to comply with a notice. There is frequently scope to contest the quantum or to establish reasonable cause, but only if you engage.
Sections 138 and 140, recovery
These come after an assessment has become a demand: recovery proceedings, and notices to your bank or debtors to pay FBR directly. If you are at this stage, the matter is urgent in a different way, and it usually means earlier notices went unanswered. It is still worth acting, recovery can often be stayed or negotiated while an appeal proceeds.
Why you probably received it
FBR holds far more information about ordinary taxpayers than most people assume: property transfers reported by registration authorities, vehicle registrations, bank account and transaction data, withholding deducted against your CNIC by employers and customers, utility consumption, and information exchanged with other countries. Notices are frequently generated by mismatches between that data and what you filed, or did not file.
This matters for the reply. If FBR is working from a specific piece of information, the effective response addresses that information directly. A generic letter saying you have complied with the law does not move anything.
What a proper reply looks like
A reasoned written submission that identifies the notice and the year, sets out the factual position, attaches the documents that evidence it, and states the legal basis where a question of law arises. Filed on IRIS within the deadline, with the acknowledgement retained.
What it is not: a one-paragraph denial, a request for more time with no substance behind it, or silence. And it is not a phone call to a friend who "knows someone in the department". That approach is at best useless.
Extensions
Where a notice genuinely cannot be answered in time, documents held by a third party, a client abroad, a genuine medical reason, an extension can be requested, and it should be requested before the deadline with reasons. An extension request filed after expiry is a much weaker position.
What we will tell you honestly
Sometimes the notice is right. If you did not file and you should have, the answer is to file, not to construct an argument. If income was understated, there are ways to resolve that which are considerably better than fighting a losing position through three levels of appeal. We will tell you where you actually stand before you spend money on a defence.
Where the notice actually arrives
FBR serves notices electronically through your IRIS inbox, with an SMS and email alert to the mobile number and address on your registration profile. That single fact explains most disasters we are called into: the notice was served properly and validly, but it went to an email nobody checks or a SIM that stopped working in 2019, and the taxpayer learns about it when a bank account is attached. Service is complete when it reaches your registered particulars, not when you happen to read it. Two habits prevent the whole category of problem: keep your mobile and email current on IRIS through a Form 181 modification whenever they change, and log into IRIS every few weeks to look at the inbox yourself. If you have never logged in, that is the first thing worth doing today.
What a reasoned reply looks like in practice
A reply that works has a recognisable shape. It identifies the notice by number, section and tax year, so nobody at the department has to guess which proceeding it belongs to. It states the facts plainly and in order. It attaches the evidence, bank statements, invoices, withholding certificates, the wealth statement working, indexed and referenced from the text, rather than dumped as forty unnamed pages. Where a question of law arises, it cites the provision and, where useful, appellate authority on the point. And it is filed on IRIS within the deadline, with the acknowledgement retained. Departmental officers handle very large caseloads; the submission that is easy to verify is the submission that gets accepted, and a well-indexed reply is doing that work for the reader on purpose.
Penalties, default surcharge and prosecution
It helps to know what the exposure actually is, because fear of the unknown drives worse decisions than the facts do. Section 182 sets out penalties for specific failures, not filing, not maintaining records, not complying with a notice, usually as a prescribed amount or a percentage of tax. Separately, default surcharge under section 205 runs on tax that was paid late, accruing with time rather than being a fixed penalty, which is why speed matters more than perfection once something is overdue. Prosecution provisions exist for serious, deliberate offences such as concealment and fraudulent evasion, and are not what an ordinary late-filer is facing. Most notices we see resolve into a computation and a payment, and the taxpayer who engages early usually ends up on the better side of the discretion available.
