A business return is not a salary return with different numbers

For a salaried person, income is a single figure on a certificate. For a business the return is built from an actual profit and loss account: revenue, cost of sales, expenses, depreciation, and then the tax computation on top. FBR's return form asks for that detail, and a return filed with round numbers pulled out of the air is a return that invites a section 177 audit selection.

The most frequent failure we see in Lahore is a trader who has never kept books, declares a comfortable-looking profit, and then cannot substantiate a single expense when the notice arrives. The expenses were real. The evidence was not kept. That is an avoidable and expensive position.

Freelancers: the export-of-services question

Freelancers earning from abroad, the Johar Town and DHA software and design crowd in particular, sit under a different regime from a domestic consultant, and the treatment turns on how the money arrives. Payments brought into Pakistan through proper banking channels, evidenced by remittance advices, are treated very differently from money that sits in a foreign wallet or arrives through informal channels. Getting this wrong is expensive in both directions: some freelancers pay far more tax than they need to, others build up an undeclared foreign position that is much harder to unwind later.

Bring us the Payoneer or Wise statements together with the bank credit advices. If you are registered with PSEB, say so, it affects the position. If you are not, ask us whether you should be.

Withholding your customers already deducted

If you invoice companies, they deduct tax under section 153 before paying you, typically at the services rate, and deposit it against your NTN. That is your money, held as a credit. Every one of those deductions belongs on your return. Ask each significant customer for the withholding certificate; most finance departments issue them on request, and the amounts are also visible in your FBR record. We chase these down because in aggregate they frequently exceed the annual liability of a small consultancy.

Minimum tax: the trap for low-margin businesses

A business can be liable to minimum tax on turnover even in a year it made little or no profit. Traders working on thin margins are the classic case: the profit is genuinely small, but the tax is calculated on turnover rather than profit and the bill lands anyway. If that is your position, it needs to be planned for during the year, not discovered in September. We check it rather than assume it.

What good record-keeping actually looks like

You do not need accounting software. A single spreadsheet with the date, party, description and amount of every sale and every expense, backed by a business bank account that you actually route business money through, puts you ahead of most small businesses in this city. If you do that for one year, next year's return is a day's work instead of a reconstruction project, and if a notice ever comes, you have answers.

Section 174: how long you must keep the records

The Ordinance requires taxpayers with business income to maintain the prescribed books, invoices and supporting documents and to retain them for six years after the end of the tax year they relate to. That retention period is why we tell clients to keep a simple, dated archive, bank statements, sales invoices, purchase receipts, withholding certificates and the filed returns themselves, rather than treating filing day as the day the paperwork can be thrown out. An assessment can be amended years after the return was filed, and the taxpayer who still holds the documents is in a completely different negotiating position from the one who does not.

Normal, minimum and final tax, which regime are you actually in?

Business income does not all compute the same way, and the return has to reflect the right regime. The normal regime taxes your actual profit at the applicable rates. Minimum tax on turnover can override that for certain taxpayers in low-profit years. And for some receipts, the tax withheld at source is a final tax, the deduction settles the liability on that income and it is reported separately rather than run through the profit computation. Exporters, certain suppliers and commission agents meet final taxation regularly, often without realising their regime changed the arithmetic of the whole return. Filing a business return properly is largely the job of classifying each revenue stream into the right regime before any number is computed, it is exactly where software-only filing services quietly get it wrong.

Frequently asked questions

I am a freelancer paid from abroad. Do I have to file in Pakistan?

If you are resident in Pakistan, yes, your income is taxable here regardless of where the client is. How it is taxed depends on how the money arrives and whether your services qualify as exports, which is exactly the part worth getting professional help with.

Do I need proper accounts, or is a summary enough?

The return itself requires a profit and loss account. We can build one from bank statements and a revenue summary if that is all you have, but the more contemporaneous your records, the stronger your position if the return is ever questioned.

My business made a loss. Do I still file?

Yes, and you particularly should. A declared loss can be carried forward against future profits, but generally only if it was properly declared in a return filed for that year. An unfiled loss year is a loss you cannot use.

What is minimum tax and will it apply to me?

It is a tax computed on turnover rather than profit, which applies to certain categories of taxpayer, so a business can owe tax in a year it barely broke even. Whether it bites depends on your category and your margins, we check this specifically.

My customers deduct tax before paying me. Do I get that back?

It is a credit against your annual liability, and if the total deducted exceeds what you owe, the excess is refundable. It is only claimable if it goes on the return, so collect the withholding certificates.

Does an AOP file separately from the partners?

Yes. The AOP files its own return and pays tax on its income. The partners then reflect their share in their personal returns, which are typically not taxed again on that share, but both filings need to be done and to agree with each other.

I sell on Daraz / Instagram. Does that count as a business?

Yes. Selling goods for profit is business income whether the shopfront is on a road or on a phone. Marketplaces also report and withhold, so the transactions are visible to FBR regardless of whether you declare them.
